2. Question and answers as follows:

Question

We are seeking further clarification on the answer for item 5.1.2 in Addendum 1.

Specifically, the clarification stated "The ITE specification was not referenced nor does not apply to this bid." We feel that under the MUTCD, the ITE specification should in fact apply to this bid, as follows:

Chapter 4K.01 General Design and Operation of Flashing Beacons states:

"Standard: Flashing Beacon units and their mountings shall follow the provisions of Chapter 4D, except as specified herein."

Chapter 4D, Section 4D.18 Design, Illumination, and Color of Signal Sections states: "Except for the requirements of this section, the requirements of the "Standards for Vehicle Traffic Control Signal Heads" (see Section 1A.1 1) shall be met."

Section 1A.11 Part 24. lists: "Vehicle Traffic Control Signal Heads," Part 1-1985 Edition; Part 2-1998 Edition (ITE).

In view of the above, and because red flashing beacons provide traffic control either as an intersection control beacon (Section 4K.02) or stop beacon (Section 4K.05), and are not considered to be a supplementary warning beacon (Section 4K.03), we feel that the ITE specification is a mandatory requirement.

The ITE specification has a significant impact on the design and performance of the solar system to be supplied.

Answer

- As the devices will not be suspended over the intersection, will be mounted on telespar or on a streetlight pole, and will only consist of the red indication, Section 4K.02 is not applicable, those are Stop Sign beacons.

- Chapter 4D, Section 4D.18 does require that Section 1A.11 be met, however Part 24 is under the SUPPORT section of Section IA.11, which as defined on page 1-1 means 4. Support-an informational statement that does not convey any degree of mandate, recommendation, authorization, prohibition, or enforceable condition. Support statements are labeled, and the text appears in unbold type. The verbs shall, should, and may are not used in Support statements.

Standard:
To the extent that they are incorporated by specific reference, the latest editions of the following publications, or those editions specifically noted, shall be a part of this Manual: "Standard Highway Signs" book (FHWA); and "Color Specifications for Retroreflective Sign and Pavement Marking Materials" (appendix to subpartF of Part 655 of Title 23 of the Code of Federal Regulations).

Support:
The "Standard Highway Signs" book includes standard alphabets and symbols for highway signs and pavement markings. You are free to meet the MUTCD standard for this issue but it is not a requirement for this bid.
